Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Mofano ("Mofano", "we", "us") governing your access to and use of the mofano.ai website, studio products, APIs and related services (together, the "Service"). By creating an account, clicking "I agree" or otherwise using the Service, you agree to these Terms. If you don't agree, do not use the Service.

Mofano is an AI-powered creative platform that lets users generate ads, videos, posters, avatars, brand kits, copy and related marketing assets using a combination of proprietary tooling and third-party AI models. Features, pricing and credit costs may change as the platform evolves.

You must be at least 16 years old and have the legal capacity to enter into a binding contract in your jurisdiction. If you use the Service on behalf of a company, you represent that you are authorised to bind that company.

You agree to provide accurate registration information, keep it updated, and maintain the confidentiality of your credentials. You are responsible for all activity under your account.

• One personal account per person.
• No sharing of credentials, except via supported team workspaces.
• Notify security@mofano.ai immediately of any unauthorised access.

5.1 Credits

Credits are the unit of consumption on Mofano. Each generation (image, video, voice, etc.) consumes a defined number of credits, shown in-app before you confirm.

5.2 Subscription tiers

Subscriptions include a monthly credit allowance. Allowance and pricing for each tier are listed at mofano.ai/pricing and may be updated with 30 days' notice for existing subscribers.

5.3 Top-up credits

Additional credits may be purchased at any time. Top-up credits do not expire while your account is active. Subscription credits expire at the end of each billing cycle unless your plan explicitly says otherwise.

5.4 Auto-renewal & cancellation

Subscriptions auto-renew at the end of each billing cycle. You can cancel any time from Studio → Account → Billing; cancellation takes effect at the end of the current cycle.

5.5 Taxes

Prices are exclusive of VAT, GST or similar taxes unless stated. You're responsible for any applicable local taxes.

You agree not to use the Service to:

• Generate or distribute illegal content, including child sexual abuse material (CSAM), content inciting violence, or content that violates export controls or sanctions.
• Generate non-consensual intimate imagery or sexualised depictions of identifiable real people.
• Impersonate real people, particularly public figures, private individuals or deceased persons, in misleading or defamatory contexts.
• Infringe the intellectual property, publicity or privacy rights of others.
• Create scams, phishing material, disinformation, election interference or coordinated inauthentic behaviour.
• Reverse-engineer, scrape, decompile, or interfere with the platform or its underlying models.
• Use the API in a way that exceeds documented rate limits, or resell access to the platform without an enterprise agreement.
• Upload malware, run security scans without permission, or otherwise attempt to compromise the Service.

We may suspend or terminate accounts that violate this section, with or without prior notice depending on severity.

7.1 Your content

You retain all rights to the brand assets you upload and to the creatives you generate on Mofano ("Customer Content"). You may use generated outputs for any lawful purpose, including commercial use.

7.2 Licence to Mofano

You grant Mofano a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, modify, transmit and display your Customer Content solely to operate, secure, improve and provide the Service to you. This licence ends when you delete the content or close your account (subject to retention periods in our Privacy Policy).

7.3 Mofano's IP

Mofano owns the Service, the website, the studio interface, the underlying tooling, brand assets and trademarks. Nothing in these Terms transfers those rights to you.

7.4 Your representations

You represent and warrant that you have all necessary rights to upload your brand assets (logos, product photos, fonts, voice samples, likenesses, etc.) and that doing so does not violate any third-party right or applicable law.

7.5 Feedback

If you send us suggestions or feedback, you grant us an unlimited right to use it without obligation.

Outputs are generated by AI models and may be inaccurate, biased, offensive or unexpectedly similar to existing works. Because of how generative AI works, Mofano cannot guarantee that any output is unique, original, factually correct, or free from third-party rights.

You are responsible for reviewing outputs before publishing them, including running your own trademark, copyright and likeness checks before commercial use.

You may cancel your subscription and delete your account at any time from Studio → Account.

We may suspend or terminate access if you violate these Terms, if we are required by law, or if continued provision would expose us to material risk. Where reasonably possible, we will give notice and an opportunity to cure.

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, Mofano's aggregate liability arising out of or in connection with the Service or these Terms will not exceed the fees you paid Mofano in the 12 months preceding the event giving rise to the claim. Mofano will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud, death or personal injury caused by negligence, or statutory consumer rights.

You agree to indemnify and hold harmless Mofano and its officers, directors, employees and agents from any claim, liability, damage, loss or expense (including reasonable legal fees) arising from your Customer Content, your use of the Service or your breach of these Terms or applicable law.

These Terms are governed by the laws of England and Wales. Before starting any formal proceeding, the parties will attempt to resolve disputes through good-faith negotiation for 30 days. Any unresolved dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, except where local consumer laws give you the right to bring proceedings where you live.

We may update these Terms from time to time. For material changes we will give at least 30 days' notice by email and an in-app banner. Continued use after the effective date means you accept the revised Terms.
